1. Definitions
In these Terms and Conditions: "Marezure", "we", "us" means Marezure, registered in Malaysia and operating from 38 Jalan Padungan, 93100 Kuching, Sarawak. "Guest" or "you" means any person making a charter booking or participating in a Marezure voyage. "Charter" means a private yacht voyage booked through Marezure. "Agreement" means the booking confirmation and these Terms and Conditions together.
2. Acceptance of Terms
By making a booking enquiry or completing a charter booking with Marezure, you confirm that you have read and agree to these Terms and Conditions. Bookings are accepted on behalf of all guests in the party. The lead guest is responsible for communicating these terms to all members of the group.
Charter bookings are available to individuals aged 18 and above. Guests under 18 may participate when accompanied by a parent or legal guardian who has accepted these Terms.
3. Services
Marezure offers three private charter voyages departing from the Kuching Waterfront, Sarawak:
- Kuching River Heritage Cruise — three-hour afternoon charter (MYR 1,080 per charter)
- Bako Coast Full Day — full-day coastal charter (MYR 3,150 per charter)
- Sarawak Delta Three-Day Exploration — three-day, two-night voyage (MYR 5,400 per charter)
All charters are private (your group only). Prices are per charter, not per person. Prices are quoted in Malaysian Ringgit (MYR) and are inclusive of the services described on our Solutions page.
4. Booking and Payment
Booking Process
Bookings are initiated through enquiry (by phone, email, or contact form) and confirmed following direct communication with the Marezure team. A booking is confirmed when Marezure sends a written booking confirmation and a deposit is received.
Deposit and Balance
- A deposit of 30% of the charter fee is required to confirm a booking
- The balance is due no later than 7 days before the charter departure date
- Payment is accepted by bank transfer to the Marezure designated account (details provided in booking confirmation)
5. Cancellations and Rescheduling
Guest-Initiated Cancellation
- Cancellation more than 14 days before departure: full deposit refund
- Cancellation 7–14 days before departure: deposit credited toward rescheduled charter (no cash refund)
- Cancellation less than 7 days before departure: deposit forfeited; balance (if paid) refunded
Weather and Safety Cancellations
If Marezure assesses conditions on the departure day as unsuitable for safe operation, the charter will be rescheduled to an agreed alternative date at no cost to the guest. No penalty applies to Marezure for weather-related rescheduling.
Marezure-Initiated Cancellation
In the unlikely event Marezure cancels for reasons other than weather (vessel maintenance emergency, crew unavailability), a full refund of all monies paid will be issued within 14 business days.
6. Guest Responsibilities
- Arrive at the Kuching Waterfront at the agreed departure time
- Disclose any medical conditions, mobility limitations, or allergies relevant to the voyage when booking
- Follow all safety instructions from the crew at all times
- Refrain from behaviour that endangers other guests or crew
- Treat the vessel, equipment, and any communities encountered with respect
- Follow wildlife-viewing guidelines provided by the guide
Guests who refuse to follow crew safety instructions may be removed from the charter without refund.
7. Prohibited Activities
- Feeding or approaching wildlife contrary to guide instructions
- Swimming outside designated areas without crew approval
- Excessive alcohol consumption that affects personal safety or group behaviour
- Commercial photography or filming for commercial purposes without prior written agreement
- Littering or disposal of waste into the water
- Entering restricted areas of any national park without prior authorisation
8. Intellectual Property
All content on the Marezure website — including text, images, and design — is the property of Marezure. Personal use (non-commercial sharing of travel photographs) is permitted. Commercial reproduction without written permission is not.
9. Liability and Disclaimers
Marezure takes all reasonable precautions to operate safe voyages in compliance with Malaysian Marine Department requirements. However, maritime activities carry inherent risks. By booking, guests acknowledge these inherent risks.
Marezure's liability for loss, injury, or damage arising from a charter is limited to the charter fee paid, except where Malaysian law prohibits such limitation. Marezure is not liable for losses arising from circumstances beyond our reasonable control, including weather events, mechanical failures despite proper maintenance, or third-party actions.
We strongly recommend that guests hold appropriate travel and medical insurance for their visit to Sarawak.
10. Health and Safety
Guests with heart conditions, respiratory conditions, serious mobility limitations, or who are pregnant should consult a medical professional before booking a maritime voyage. Marezure may decline a booking on safety grounds where disclosed health conditions pose a risk to the guest or crew.
11. Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from a charter booking will be subject to the jurisdiction of the courts of Sarawak, Malaysia. We encourage guests to contact us in the first instance to resolve any concerns informally.
12. Changes to Terms
Marezure may update these Terms from time to time. The updated version will be published on this page with a revised "Last Updated" date. Bookings made after the updated date are subject to the current Terms.
